1. Introduction

Welcome to FluxPMS, a service provided by FluxSoft Technologies, LLC (hereinafter "Company"). By creating an account or using our hotel management services, you agree to these Terms. If you represent a hotel or entity, you confirm you have authority to bind them.

2. The Service

FluxPMS is a cloud-based Property Management System (PMS) provided as Software-as-a-Service (SaaS). We grant you a limited, non-exclusive, non-transferable license to use the service for managing your hospitality business.

3. Free Trial

  • Duration: New accounts receive a 7-day free trial with full access to all features.
  • Payment Method: A valid credit/debit card is required to start the trial, but you will not be charged until the trial ends.
  • Reminder: We will send email reminders before your trial expires (Day 5 and Day 7).
  • Cancellation: Cancel anytime during the trial and you will not be charged.
  • Post-Trial: After 7 days, your card will be automatically charged for the selected plan.

4. Subscription & Billing

Annual Plans (Pay 10 Months, Get 12)

  • Essential Annual: $290/year (save $58)
  • Professional Annual: $790/year (save $158)
  • Ultimate Annual: $1,990/year (save $398)

Billing Terms

  • Service is billed in advance on a monthly or annual basis.
  • Plans have limits on Rooms and Properties. We may restrict resource creation if limits are exceeded.
  • Prices may change with 30 days notice.

Refunds

  • 7-Day Money-Back Guarantee: New paying customers may request a full refund within 7 days of first payment.
  • Annual Plans: Pro-rated refunds available within first 30 days only.
  • Monthly Plans: No refunds after the 7-day guarantee period.

5. Payment Failure & Retry

  • If payment fails, we will automatically retry daily for up to 5 days.
  • After 5 failed attempts, your account may be suspended.
  • Access will be restored immediately upon successful payment.
  • We will notify you via email of any payment issues.

6. Account Types & Responsibilities

Account Holder (Admin)

  • The person who creates the account is the primary administrator.
  • We recommend using a personal email (not a shared hotel email) to prevent unauthorized access.
  • The Admin is responsible for all activity under their account.

Users (Staff)

  • Admins may invite additional users (Managers, Receptionists).
  • Each user has role-specific access and permissions.
  • User limits depend on your subscription plan.

7. Your Data

  • Ownership: You own your guest data ("Customer Data"). We process it only to provide the service.
  • Portability: You may export your data at any time.
  • Deletion: Upon account termination, your data will be deleted within 90 days.
  • Compliance: You must comply with local laws (e.g., collecting tourist taxes, guest registration requirements).

8. Service Level Agreement (SLA)

  • We aim for 99.9% uptime.
  • In the event of significant downtime (>4 hours), you may request a pro-rated credit for that month.
  • We are not liable for outages caused by third parties (hosting providers, payment gateways).

9. Limitation of Liability

To the maximum extent permitted by law, the Company shall not be liable for any indirect, incidental, or consequential damages (including lost profits or data). Our total liability is limited to the amount you paid us in the last 12 months.

10. Termination

  • You may cancel your subscription at any time from Settings.
  • Upon cancellation, you retain access until the end of your billing period.
  • We may terminate accounts that violate these Terms or engage in fraudulent activity.

11. Changes to Terms

We may update these Terms with 30 days notice via email. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of Guatemala. Any disputes shall be resolved in the courts of Guatemala City.
